Update on the FTC’s Rule to Ban Employee Non-Competes Nationwide
On April 23, 2024, the Federal Trade Commission (FTC) adopted a rule banning employers from using non-competes with nearly all employees in the United States. This sweeping, nationwide regulation extends to other types of agreements such as non-solicitation and confidentiality agreements, as well as other restrictive covenants that could arguably prevent competition. Unless enjoined in pending litigation, the FTC’s rule will take effect on September 4, 2024.
To discuss this adopted rule, Gunderson Dettmer Employment & Labor Partner Max Perlman and Strategic Transactions & Licensing Partner Aaron Rubin hosted the webinar, “Update on the FTC’s Rule to Ban Employee Non-Competes Nationwide.”
